These terms are an agreement between you and Happiour ("we") for your use of the Happiour iOS app and this website (the "Service"). By using the Service, you agree to them. If you don't agree, please don't use the Service.
Who can use Happiour
You must be at least 18 years old. Happiour includes alcohol promotions, and it's your responsibility to follow the law where you are. Only buy or drink alcohol if you're of legal drinking age, which is 21 in the United States. Please drink responsibly and never drink and drive.
What Happiour is
Happiour is a directory of lunch specials and happy hour deals. We gather listings from restaurant websites and public sources. We don't sell food or drinks, take reservations, or process payments, and restaurants are solely responsible for their food, drinks, service, and premises. A listing doesn't mean that we endorse a restaurant or that it endorses or is affiliated with us, unless we say so.
Deals can change
Always confirm a deal with the restaurant before you go. Prices, items, hours, and availability can change without notice, and a listing or "live" status may be out of date or wrong. Restaurants decide whether to honor a deal. Photos may be illustrative, and may not show the restaurant or the actual food or drink offered. Distances are estimates.

Acceptable use
You agree not to:
- break the law or infringe anyone's rights while using the Service;
- copy or scrape the Service or its data in bulk, or use it to build a competing product;
- interfere with, overload, or try to gain unauthorized access to the Service; or
- reverse engineer the app, except where the law allows this despite this restriction.
Your license and our content
We give you a personal, non-exclusive, non-transferable, revocable license to use the app on Apple devices you own or control, as allowed by the App Store's usage rules, for your non-commercial use. Happiour, its logo, and the Service's design and content are owned by us or our licensors. Restaurant names and marks belong to their owners.
Links and other services
The Service links to maps, restaurant websites, and other services that we don't control. We aren't responsible for their content, availability, or practices.
Privacy
Our Privacy Policy explains how we handle information.
Changes and availability
We may change, suspend, or stop any part of the Service at any time. We may update these terms by posting a new version on this page with a new date. If a change is significant, we'll also give notice in the app or on this website. If you keep using the Service after a change takes effect, you accept the updated terms.
Disclaimers
To the fullest extent the law allows, the Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We don't promise that the Service will be uninterrupted or error-free, or that any listing will be accurate or current.
Limit of liability
To the fullest extent the law allows, we won't be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. We also won't be liable for any dealings you have with a restaurant, including any deal it doesn't honor. Our total liability for all claims relating to the Service won't exceed US$50. Some places don't allow these limits, so some of them may not apply to you. Nothing in these terms limits rights that can't be limited by law.
Indemnity
If your misuse of the Service or breach of these terms leads to a claim against us by someone else, you agree to cover the resulting reasonable losses and costs, to the extent the law allows.
Governing law
These terms are governed by the laws of the State of Georgia, without regard to its conflict-of-law rules, except where the law where you live requires otherwise. Disputes will be handled in the state or federal courts located in Georgia, unless the law requires a different location.
Apple
If you downloaded the app from the App Store, you and we also agree that:
- these terms are between you and us, not Apple, and we, not Apple, are responsible for the app;
- your use of the app must follow the App Store Terms of Service and its usage rules;
- Apple has no obligation to provide maintenance or support for the app;
- if the app fails to meet an applicable warranty, you may notify Apple for a refund of any purchase price, and Apple has no other warranty obligation regarding the app, to the extent the law allows;
- we, not Apple, are responsible for addressing claims relating to the app, including product liability, legal or regulatory compliance, consumer protection, privacy, and intellectual property claims;
- you confirm that you aren't barred from using the app under US sanctions or export laws; and
- Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
General
If part of these terms can't be enforced, the rest stays in effect. If we don't enforce a term right away, we can still enforce it later. You can't transfer these terms without our consent. We may transfer them as part of a sale or reorganization. These terms, together with anything they refer to, are the whole agreement between you and us about the Service.
